The article addresses the role of scarcity in negotiating the relationship between intellectual property, particularly from a legal-economic perspective, and property rights, as understood by transaction cost economics, to shed light on the deadlock faced by those suffering from neglected tropical diseases (NTDs). The consistency of the law and economics fundamentals that support the trade on knowledge goods, namely patents on essential medicines, is put under check by Scott Veitch’s scholarship on legal irresponsibility. The damages that emerge from the operations (...) of the intellectual property system are registered in the novel concept of negative public domain, and are due mainly to the lack of access to treatments that end up being unaffordable, or to innovation that leads to new drugs that is not sufficiently incentivised though price signals. The accountability for such damages is taken into consideration by arguing that the disavowal of responsibility is made possible by the negative public domain, which is balanced by the construction of a positive response through the language of rights. As such, responsibility per se is preserved, evading one instantiation of Teubner’s legal paradoxes, but rendered ineffective by design. In other words, even if the harms endured by those affected by the NTDs can be traced back to the operations of the intellectual property system, there is no one to hold accountable. The main goal pursued through the article is to make such an arrangement explicit, by giving centrality to the notion of scarcity and its interplay between legal and economic theory, alongside the novel concept of negative public domain as a site where the actual consequences of irresponsibility lie, to hopefully inform further critique in subsequent works. The exchange of goods and services between individuals is often formalised by a contract in which the parties establish norms to define what is expected of each one. Norms use deontic statements of obligation, prohibition, and permission, which may be in conflict. The task of manually detecting norm conflicts can be time–consuming and error-prone since contracts can be vast and complex. To automate such tasks, we develop an approach to identify potential conflicts between norms. We show the effectiveness of our (...) approach and its individual components empirically using two publicly available corpora, and contribute with a new annotated test corpus for norm conflict identification. Therapeutic strategies capable of inducing and enhancing prosthesis embodiment are a key point for better adaptation to and acceptance of prosthetic limbs. In this study, we developed a training protocol using an EMG-based human-machine interface that was applied in the preprosthetic rehabilitation phase of people with amputation. This is a case series with the objective of evaluating the induction and enhancement of the embodiment of a virtual prosthesis. Six men and a woman with unilateral transfemoral traumatic amputation without previous use (...) of prostheses participated in the study. Participants performed a training protocol with the EMG-based HMI, composed of six sessions held twice a week, each lasting 30 mins. This system consisted of myoelectric control of the movements of a virtual prosthesis immersed in a 3D virtual environment. Additionally, vibrotactile stimuli were provided on the participant’s back corresponding to the movements performed. Embodiment was investigated from the following set of measurements: skin conductance response, crossmodal congruency effect, ability to control the virtual prosthesis, and reports before and after the training. The increase in the skin conductance response in conditions where the virtual prosthesis was threatened, recalibration of the peripersonal space perception identified by the crossmodal congruency effect, ability to control the virtual prosthesis, and participant reports consistently showed the induction and enhancement of virtual prosthesis embodiment. Therefore, this protocol using EMG-based HMI was shown to be a viable option to achieve and enhance the embodiment of a virtual prosthetic limb. (shrink)

Through the application of Material Engagement Theory to enactivist analyses of social cognition, this paper seeks to examine the role of material culture in shaping the development of intersubjectivity and long-term scalar transformations in social interaction. The deep history of human sociality reveals a capacity for communities to self-organise at radically emergent scales across a variety of temporal and spatial ranges. This ability to generate and participate in heterogenous, multiscalar relationships and identities demonstrates the developmental plasticity of human intersubjectivity. Perhaps (...) human sociality’s most unique feature is this intersubjective plasticity, that is, the ability for diverse collectivities of individuals and groups to adopt and transition between numerous social identities and behaviours with profound rapidity and flexibility. However, the most influential models in the study of social cognition, the Social Intelligence Hypothesis and Theory of Mind, promote a view of intersubjectivity that is rooted in methodological individualism and primarily understood as a capacity for observation and prediction. This approach leads to significant issues when confronted with the diversity and plasticity of hominin social organisation, particularly in regards to the computational burdens and information processing bottlenecks such scalar changes imply for cognitivist models. This paper examines the metaphysical assumptions in computational models of the mind that result in representational apriorism and an epiphenomenal treatment of material culture that hinder our understanding of the evolution and development of social cognition. Specifically, this article critiques the logics of computation, information processing, representationalism, and content within Neo-Darwinian frameworks that obscure and distort the interrelationships of evolutionary, developmental, ecological and cultural processes. Through a synthesis of material engagement and enactivist approaches to social cognition, this article argues that it is possible to explain the emergent and multiscalar dynamics of hominin sociality in terms of ecologically distributed and developmentally plastic interactions between brains, bodies and material culture. It is common to hear talk of the aim of belief and to find philosophers appealing to that aim for numerous explanatory purposes. What belief 's aim explains depends, of course, on what that aim is. Many hold that it is somehow related to truth, but there are various ways in which one might specify belief 's aim using the notion of truth. In this article, by considering whether they can account for belief 's standard of correctness and the epistemic (...) norms governing belief, I argue against certain prominent specifications of belief 's aim given in terms of truth, and advance a neglected alternative. In this paper, we recover the idea cast by Graham Priest to our ears in 2000: That it was possible to experience Ontological Paraconsistency in life. He had, back then, as a translation of his thinking, a painting by Escher: The stairs could be going up or down, and one could not tell where they were going by simply examining the painting. The most obvious argument as to why that was not an instance of Ontological Paraconsistency found in reality was (...) that the perspective from which you would have to stare at the painting to see something different would be different too, so that it was impossible that we were getting up and down at the same time, that is, from the same perspective. That would happen with anything we picked in this world. We recently found something that does not entirely belong to this world, however, something that could finally satisfy the requirements of Priest, and therefore prove to us that there is a place for Ontological Paraconsistency. We observe that the paraconsistent robot, Emmy (Abe et al., 2006), is an application of the Non-ontological Paraconsistency, which we always believed to be passive of existence, but we here talk about another type of paraconsistency, which would be intrinsic to the being. The purpose of this paper is then providing a definite answer to the questions: Is there any real life instance of Ontological Paraconsistency? Is Ontological Paraconsistency a useful concept in terms of logical theories? (shrink)

In this paper, I sketch a Kantian account of duties of rescue, which I take to be compatible with Kant’s theory. I argue that there is in fact no “trumping relation” between imperfect and perfect duties but merely that “latitude shrinks away” in certain circumstances. Against possible demandingness objections, I explain why Kant thought that imperfect duty must allow latitude for choice and argue that we must understand the necessary space for pursuing one’s own happiness as entailed by Kant’s justification (...) of one’s duty to promote other’s happiness. Nevertheless, becoming worthy of happiness has always priority over one’s own happiness, even when circumstances are such that we cannot secure our own happiness without seriously neglecting more pressing needs of other persons. I conclude that Kant’s moral theory calls for complementation by the political and juridical domain. Implementing just political institutions and creating satisfactorily well-ordered societies create an external world which is friendlier to our attempts to reconcile moral integrity and a happy human life. Public health nurses (PHN) have had a long history of working with new mothers in the community. Their practice includes collaboration, building therapeutic relationships, mutual goal setting, establishing trust, supporting clients’ strengths, empowerment and social justice. The wealth of information that new mothers receive both solicited and unsolicited may come from many different sources such as medicine, midwifery and those created personally by families. Although much of the information on mothering is presented with the intent of helping, it can also (...) be hegemonic and oppressive depending on different discourses, stereotypes and myths of mothering and therefore may cause confusion, guilt and uncertainty. Public health nurses often address conflicting social, cultural and personal discourses about mothering practices in order to support an empowering mothering experience. The term ‘social mediator’ was purposefully created in an attempt to describe the unique work of PHNs that this author has witnessed through her own research and practice as a PHN. This paper will present a discussion of the author's own work and research findings that will suggest how feminist poststructuralist theory may be used to guide and understand information exchange between PHNs and mothers as they mediate different social, cultural and personal discourses on mothering. Bien común y ciudadanía en una era emotivista: la política identitaria como vector de crisis y renovación del debate público Este artículo analiza los conceptos de ciudadanía y bien común, considerando la crisis del debate público provocada, entre otras causas, por una distorsión de las políticas identitarias, en el contexto del emotivismo moral moderno. Para ello, este trabajo adopta la metodología de la revisión bibliográfica para desarrollar un análisis teórico de conceptos centrales de la filosofía práctica contemporánea, abarcando diversas referencias, (...) como MacIntyre, Lilla, Taylor, Finnis, Sandel y Kymlicka. Tras presentar el diagnóstico de MacIntyre sobre el ethos emotivista moderno como factor de insolubilidad de las controversias morales y la crítica de Lilla a la despolitización causada por el atomismo de las políticas identitarias, se estudian las condiciones para la rehabilitación teórica de los conceptos de ciudadanía y bien común, a partir de una ética aristotélica y comunitaria relativa a la razón práctica, en virtud de la cual la amistad cívica es relevante para equilibrar las diferencias dentro de una unidad política mayor. La conclusión es que las políticas de identidad pueden salvaguardarse si se ponderan con el concepto de bien común, para así superar las contradicciones emotivistas del debate público. (shrink)

In this paper, I analyze the least discussed of Kant’s four examples of duty in the first section of his Groundwork to the Metaphysics of Morals: the gout sufferer who is no longer motivated by natural interest in his long-term wellbeing, and is thus in a unique position to secure his own happiness from duty. This example has long been wrongly interpreted as a failure of prudential rationality, as recently illustrated by Allen Wood’s reading of that example. -/- I argue (...) that the gout sufferer example is meant to illustrate a violation of a duty to the self and should not be confused with mere prudential failure. The example also helps us understand the line between prudential reason and duties to the self. I show that given Kant’s conception of happiness as an indeterminate concept and his hedonistic account of non-moral ends, it can sometimes be more rational from the perspective of empirical practical reason to choose short term over long-term wellbeing when long term wellbeing seems uncertain in regard to expected pleasure. In other words: Kant’s account of empirical practical reason does not rule out as irrational choosing short term pleasure at the expense of long-term wellbeing. However, this is precisely why the gout sufferer’s long-term happiness can be directly morally required and so becomes the content of a duty to the self. To explain how there can be a direct duty to promote our own happiness under certain circumstances I also elucidate Kant’s distinction between direct and indirect duties. (shrink)

Aims and objectives. Participant narratives from a feminist and queer phe- nomenological study aim to broaden current understandings of trauma. Examin- ing structural marginalisation within perinatal care relationships provides insights into the impact of dominant models of care on queer birthing women. More specifically, validation of queer experience as a key finding from the study offers trauma-informed strategies that reconstruct formerly disempowering perinatal relationships. Background. Heteronormativity governs birthing spaces and presents considerable challenges for queer birthing women who may also have (...) an increased risk of trauma due to structurally marginalising processes that create and maintain socially constructed differences. Design. Analysis of the qualitative data was guided by feminist and queer phe- nomenology. This was well suited to understanding queer women’s storied narra- tives of trauma, including disempowering processes of structural marginalisation. Methods. Semistructured and conversational interviews were conducted with a purposeful sample of thirteen queer-identified women who had experiences of birthing in rural Nova Scotia, Canada. Results. Validation was identified as meaningful for queer women in the context of perinatal care in rural Nova Scotia. Offering new perspectives on traditional models of assessment provide strategies to create a context of care that recon- structs the birthing space insofar as women at risk do not have to come out as queer in opposition to the expectation of heterosexuality. Conclusions. Normative practices were found to further the effects of structural marginalisation suggesting that perinatal care providers, including nurses, can challenge dominant models of care and reconstruct the relationality between queer women and formerly disempowering expectations of heteronormativity that govern birthing spaces. Relevance to clinical practice. New trauma-informed assessment strategies recon- struct the relationality within historically disempowering perinatal relationships through potentiating difference which avoids retraumatising women with re- experiencing the process of coming out as queer in opposition to the expectation of heterosexuality. The Triple Helix is a global model originating in developed economies but less developed countries have also made attempts to implement it into their national contexts. Meanwhile, the national context can be characterised by means-ends decoupling at the state level which implies that policies and practices of the state are disconnected from its core goal of creating public welfare. It refers to the oligarchic economies in which the state is captured by exploitative, rent-seeking oligarchies in business and politics. Ukraine is (...) an example of such a country. Thus, the research question is: how did means-ends decoupling at the state level affect the implementation of the Triple Helix model in Ukraine? To answer this question, we employed both rational choice institutionalism and sociological institutionalism. The data emanate from interviews with the senior managers of four universities and science parks established within them. The findings reveal that means-ends decoupling at the state level, caused by the rent-seeking behaviour of business and political oligarchies, led to the implementation of the Triple Helix model in Ukraine also reflecting a case of means-ends decoupling. The greater the institutional complexity experienced by the science park and the more the senior managers of the university and the science park maintain a logic of confidence in practices that deviate from the Triple Helix model, the greater rent-seeking and means-ends decoupling at the organisational level. Both rent-seeking and means-ends decoupling were found to not only hinder economic growth but also result in a diversion of human intellectual capital. (shrink)

The aim of this essay is to analyze the treatment of the theory of natural slavery in Francisco de Vitoria’s thought through his reception of Aquino’s treatise on justice and the Aristotelian theory of natural slavery as described in book I of Politics. In order to understand how Vitoria distances himself from Aquinas, by considering the ius gentium as a positive right, I analyze Victoria’s comments on the Summa Theologica. Drawing on Mary Russo’s theorization of ‘female grotesques’, this article analyses Take a Peek! – a circus, fairground-styled ‘freak’ show by British performance artist, Bobby Baker. While making a display of or a spectacle out of herself can be argued for all of Baker’s work, Take a Peek!, the third show in her ‘Daily Life’ series, is especially concerned with ‘woman’ on display. The article argues that in Take a Peek! Baker turns herself into a ‘spectacular’ demonstration of ‘failed’ femininity (...) in a way that constitutes a site/sight of feminist critical ‘work’. The analysis proceeds by detailing the various ways in which Baker realizes her performance through strategies that serve to grotesque the feminine and figure an archaic maternal, the sorceress and the hysteric. In conclusion, Baker’s invitation to laugh at the grotesquing of her own body is proposed as a means of empowering those who look, to look differently at the ideas and ‘ideals’ that shape the feminine in contemporary cultural and social systems, and to expose the symbolic feminine for what it truly is – a freak show. This article examines an area of Thessalian mythology and cult surrounding the figures of Thetis the Nereid and Cheiron the centaur. It argues that the pair derive a substantial amount of their characterisation, in ancient narratives, from their mutual association, and that only by studying them together can we receive a full insight into their mythological and religious personae. Thetis and Cheiron are shown to differ significantly with regard to a number of themes, such as their relationship with symbolic topography (...) and the natural landscape of Thessaly and – most strikingly – their kourotrophic roles. Thetis’ strong association with ambiguous nurture is argued to connect with her physical conception, especially her association with the shape-changing sepia, cuttlefish, an association which involves her in the wider ancient discourse of unreliable female beauty. It is also shown that the Thetis of Homeric epic is significantly different from the Thetis found in other ancient narratives.Cet article étudie une partie de la mythologie et du culte thessaliens autour des figures de la Néréide Thétis et du centaure Chiron. Il montre qu’une part importante de leur caractéristiques, dans les récits anciens, provient de leur association et que c’est seulement en les étudiant ensemble qu’on prend la pleine mesure de leur dimension mythologique et religieuse. Thétis et Chiron présentent des différences substantielles sur un certain nombre de plans, tels que leur relation à la topographie symbolique et au paysage naturel de la Thessalie, et, de manière plus surprenante, leur rôle de courotrophes. L’association étroite entre Thétis et l’ambiguïté du nourrissage est mise en relation avec sa constitution physique et avec le sepia protiforme, le poulpe. Cette dernière association l’insère dans un ample discours ancien sur la duplicité de la beauté féminine. En outre, la Thétis de l’épopée homérique est fort différente de la Thétis que l’on trouve dans les autres récits anciens. (shrink)

Em Pascal, por meio da crítica à razão discursiva que estava à sua época em vias de consagração, está em curso a defesa de uma concepção alargada da racionalidade, que procura estendê-la a partir de uma perspectiva anti-intuicionista e antifundacionista radical para dimensões da realidade que o arranjo epistemológico gestado pela filosofia cartesiana quer deixar de fora. A hipótese que gostaríamos de discutir é a de que essa subversão se dá pela desestabilização desse arranjo por meio da descrição que Pascal (...) realiza, em Pensamentos, da faculdade imaginação, cujo interesse para o estudo da verdade deve ser considerado para que se possa entender a inflexão que a epistemologia pascaliana tenta empreender ante as outras de seu tempo.
